Welcome to Apexe Academy. These Terms & Conditions (“Terms”) govern your access to and use of the website apexeacademy.com, our online courses, community, and related services (together, the “Services”), operated by Apexe Academy.

By accessing our website, creating an account, or purchasing any course, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. DEFINITIONS

“We”, “us”, “our”, and “Apexe” refer to Apexe Academy. “You” and “User” refer to anyone who accesses, registers for, or purchases our Services. “Content” refers to all course videos, materials, resources, downloads, and related assets. “Course” refers to any paid program or learning product offered by Apexe Academy.

2. ELIGIBILITY

To purchase or use our Services, you must be capable of forming a legally binding contract under applicable Indian law. If you are under 18 years of age, you may use the Services only with the involvement, supervision, and consent of a parent or legal guardian, who agrees to these Terms on your behalf and accepts responsibility for your use of the Services. You confirm that all information you provide to us is accurate and complete.

3. ACCOUNTS & ACCESS

When you purchase a Course, access details and links are delivered to the email address you provide at checkout. You are responsible for keeping these details confidential. Access to our Content is personal to you, non-transferable, and intended for a single user. You may not share, lend, or transfer your access, login credentials, or links with anyone else. We reserve the right to suspend or revoke access if we reasonably believe these Terms have been breached.

4. COURSES, CONTENT & DELIVERY

Our Courses are digital products delivered electronically. After your payment is successfully processed, access is provided via email and/or a community link. No physical product is shipped. Your access to a purchased Course lasts for a duration of 6 months. We may update, improve, or modify Course Content from time to time to keep it relevant. Please note that Apexe Academy does not issue course-completion certificates; the value of our Courses lies in the skills and practical work you build.

5. PRICING & PAYMENTS

All prices are listed in Indian Rupees (INR) on our website. We may change our prices at any time, but any change will not affect purchases you have already completed. Payments are processed securely through our third-party payment gateway, Razorpay. We do not collect or store your card or banking details. Applicable taxes (including GST, where relevant) may be added to or included in the listed price. Optional add-on products (“order bumps”) offered at checkout are additional digital products that you may choose to purchase alongside your Course.

6. REFUNDS & CANCELLATION

All of our products are digital, downloadable products, and all purchases are final once delivered. We do not offer refunds for change of mind, dissatisfaction, non-use of the product, or the results you do or do not achieve.

A refund may be requested within 7 days of payment only in limited circumstances — specifically, where we are unable to deliver your product, where the product does not include the modules promised on its landing page, or where the product is defective. These circumstances, the eligibility conditions, and the process for requesting a refund are set out in full in our Refund & Returns Policy, which forms part of these Terms.

7. INTELLECTUAL PROPERTY

All Content provided through our Services is owned by or licensed to Apexe Academy and is protected by applicable copyright and intellectual property laws. Upon purchase, you are granted a limited, personal, non-transferable, non-exclusive, and revocable license to access and use the Content solely for your own learning. You may not copy, record, download (except where expressly permitted), reproduce, redistribute, resell, publish, share, or use any Content for commercial purposes. Any unauthorized use will result in immediate termination of your access without refund, and may lead to legal action.

8. ACCEPTABLE USE & COMMUNITY CONDUCT

You agree to use our Services lawfully and respectfully. You must not share your access with others, pirate or redistribute our Content, or engage in any activity that disrupts the Services. Our community operates on third-party platforms such as WhatsApp and Telegram. Within these communities, you agree to be respectful to other members and our team, and to avoid spam, harassment, hate speech, illegal content, or unsolicited self-promotion. We reserve the right to remove any member from our community, and to suspend their access, for any conduct we consider harmful or in breach of these Terms.

9. NO GUARANTEE OF RESULTS OR EMPLOYMENT

Our Courses are educational and designed to help you build real, job-ready skills. However, your results depend entirely on your own effort, practice, and circumstances. We do not guarantee any specific outcome, including any job, salary, income, freelance work, client, placement, or career result. Where we facilitate freelance projects, placements, or opportunities through our partner network, these are made available subject to availability and merit, and are never guaranteed. Any testimonials, examples, or case studies shared by us reflect individual experiences and are not promises of similar results.

10. THIRD-PARTY SERVICES & PLATFORMS

We rely on third-party services to operate, including (but not limited to) Razorpay for payments, our hosting provider, and messaging platforms such as WhatsApp and Telegram for our community. Your use of these third-party platforms is also governed by their own terms and policies. We are not responsible for the availability, content, or practices of any third-party service.

11. DISCLAIMER OF WARRANTIES

Our Services are provided on an “as is” and “as available” basis. While we work hard to deliver high-quality Content and a reliable experience, we do not warrant that the Services will be uninterrupted, error-free, or free of technical issues, or that the Content will meet every individual expectation.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the total liability of Apexe Academy arising out of or relating to your use of the Services or any Course shall not exceed the amount you actually paid for that Course. We shall not be liable for any indirect, incidental, special, or consequential damages of any kind.

13. TERMINATION

We reserve the right to suspend or terminate your access to the Services, at our discretion and without refund, if you breach these Terms or engage in conduct we consider harmful to Apexe Academy, our team, or our community.

14. PRIVACY

Your personal information is handled in accordance with our Privacy Policy, which explains what we collect and how we use it. By using our Services, you consent to that policy.

15. CHANGES TO THESE TERMS

We may update or revise these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

16. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
